1. Purpose
These Terms and Conditions of Sale (the “Terms”) set out the terms of the working relationship between the Senegal Rent platform and owners wishing to list and market their accommodation.
Senegal Rent provides a listing, distribution and optimization service, including both free and paid services.
2. Nature of the service
Senegal Rent acts as:
- an intermediary putting parties in contact
- a multichannel distribution agency
- a marketing and commercial services provider
Senegal Rent is not the owner of the properties offered and does not take part in the performance of the stay.
3. Free listing
A property may be listed free of charge subject to compliance with the following conditions:
- provision of professional-quality or otherwise adequate photos
- full completion of the listing
- indication of prices (high and low season)
- keeping availability up to date
Senegal Rent reserves the right to refuse or remove any listing that does not meet its quality standards.
4. Paid offers
4.1 Premium Pack
The Premium Pack notably includes:
- photo shoot
- optimized copywriting
- temporary featured placement
- optimization of the listing
This service is billed as a one-time payment.
4.2 Visibility Pack
The Visibility Pack notably includes:
- creation and distribution of listings on the main international booking platforms, subject to their availability and their own admission conditions
- calendar synchronization
- price optimization
- ongoing management and performance improvement
This service includes:
- set-up fees
- a monthly subscription
5. Commission on sales
Under the Visibility Pack, Senegal Rent receives a commission on bookings generated via partner platforms.
👉 This commission is set at 7% of the total amount of the booking.
This commission applies independently of the commissions charged by the partner platforms.
This 7% commission applies only to bookings made on the partner platforms that Senegal Rent manages on the owner’s behalf. It does not apply to bookings made on the Platform, which are governed by Article 5 bis: on those bookings, Senegal Rent’s remuneration consists of the 20% booking fee paid online by the client, and no commission is owed by the owner.
5 bis. Displayed price and remuneration on bookings made through the Platform
The owner communicates to Senegal Rent the price at which they wish to rent out their property, hereinafter the “owner price.”
The price displayed to the public on the Platform is the owner price increased by 5%. This increase is disclosed to the owner, who accepts it by agreeing to these Terms. It allows Senegal Rent to run promotional operations without asking the owner to change their own rate.
At the time of booking, the client pays online, as the booking fee, a sum equal to 20% of the owner price for the duration of the stay — being 15% deducted from the owner price and 5% added to the price displayed to the traveller —, plus value added tax at the rate in force in Senegal — 18% at the date of these Terms. The owner collects the balance of the displayed amount directly from the client, on site, i.e. 85% of their owner price. The owner makes no payment to Senegal Rent: its remuneration is collected in full online from the client.
Example, for an owner price of 50,000 FCFA per night and a three-night stay: the displayed price is 52,500 FCFA per night, i.e. 157,500 FCFA in total. The booking fee is 30,000 FCFA (20% of the 150,000 FCFA owner price), to which 5,400 FCFA of value added tax is added: the client pays 35,400 FCFA online and hands over 127,500 FCFA to the owner on arrival — i.e. 42,500 FCFA per night, 85% of their price. What the owner receives is unaffected by the tax.
The booking fee is exclusive of tax. The value added tax payable in respect of this service, at the rate in force in Senegal — 18% at the date of these Terms — is added to it. Senegal Rent, which is liable for that tax, charges it and shows it separately on the invoice issued to the client. It applies to the booking fee only, never to the price of the stay.
The owner price is communicated by the owner and is understood to be inclusive of all taxes where applicable. It is for the owner to determine whether they are liable for value added tax in respect of their rental activity, to take this into account in the price they communicate, and to file the corresponding returns; Senegal Rent is not liable for these taxes and takes no part in collecting them. An owner who is not liable for VAT does not recover the value added tax that Senegal Rent charges on its own services: for them it is a final cost.
The booking fee is calculated on the owner price for the duration of the stay. Any security deposit requested by the owner and the tourism promotion tax are not included in this basis: they are settled on site and are not collected by Senegal Rent.
Non-negotiable nature. The 15% deducted from the owner price and the 5% added to the displayed price are an essential condition of the partnership. They pay for the sales team, advertising expenditure and the operation of the Platform. They are not subject to individual negotiation: the same conditions apply to every listed owner.
Price parity. The owner warrants that the owner price communicated to Senegal Rent matches the price they themselves charge on direct sales for the same property, for the same dates and on equivalent conditions. The owner shall not increase the communicated price in order to absorb all or part of the booking fee.
No additional sum on site. The owner may not claim from the client on arrival any sum other than the balance of the displayed amount, the stated security deposit, the advance on the balance provided for in Article 7 bis and the tourism promotion tax. Every confirmed booking is honoured at the price in force on the date of its confirmation; a change to the owner price takes effect only for bookings made after it is recorded. Failure to comply with these obligations falls under Article 11.
5 ter. Rate surveys and proposed adjustment
Senegal Rent carries out regular surveys of the rates charged for comparable properties, including the owner’s own rates where these are published on other channels.
Where a survey reveals a difference between the owner price communicated to Senegal Rent and a public rate observed elsewhere for the same property, for the same dates and on equivalent terms, Senegal Rent informs the owner and may propose an adjustment to their owner price.
Such a proposal has no effect unless and until the owner accepts it. The owner alone sets their owner price and remains free to decline the proposal; no such refusal may give rise to suspension, termination or any change to their listing.
Senegal Rent does not alter the owner price on its own initiative. Any commercial action it takes on the displayed price is set against the increase provided for in Article 5 bis and has no effect on the amount received by the owner.
6. Wallet system (prepaid account)
In order to guarantee payment of the commissions due under Article 5 (bookings on partner platforms):
- the owner must fund a prepaid account (wallet)
- commissions are automatically deducted from this balance
- a minimum balance may be required
👉 In the event of an insufficient balance:
- the distribution of listings may be suspended
- services may be interrupted without notice
7. Payment for stays
The client pays online, at the time of booking, Senegal Rent's booking fee, equal to 20% of the owner price for the duration of the stay, on the terms of Article 5 bis. The owner collects the balance of the stay directly from the client, on site. The owner has no payment to make to Senegal Rent in respect of this fee.
Senegal Rent does not take part in managing payment of the balance, nor in the financial flows between the client and the owner.
7 bis. Cancellation
Uniform conditions. The cancellation conditions applicable to bookings made through the Platform are identical for all listed accommodation and are not subject to any individual arrangement. They are set out in the Terms of Use and on the public “Cancellation Policy” page. The applicable season is determined by the client’s arrival date, not by the booking date.
Deadlines. The client may cancel free of charge up to seven (7) days before the arrival date in low season (1 June – 31 October) and up to fourteen (14) days before the arrival date in high season (1 November – 31 May). The client also has a right of cancellation within twenty-four hours of payment, except for a booking made less than forty-eight hours before arrival, which is final as soon as it is confirmed.
Late cancellation and compensation of the owner. Beyond those deadlines the booking is final and the booking fee is retained by Senegal Rent. Half of that fee (50%) is paid to the owner as compensation for the dates that were blocked, within the month following the scheduled arrival date.
Advance on the balance of the stay. The owner may request an advance on the balance of the stay for villas in high season and for long stays. That advance is paid directly to the owner, who collects it and is solely responsible for refunding it. It is stated on the listing before booking and remains separate from the booking fee.
Cancellation by the owner. Where the owner cancels, they shall inform Senegal Rent without delay; Senegal Rent shall offer the client an equivalent solution or, failing that, refund the booking fee in full.
8. Owner's undertakings
The owner undertakes to:
- provide accurate and up-to-date information
- honor confirmed bookings
- welcome clients under the conditions advertised
- maintain a quality of service consistent with the platform's standards
9. Non-circumvention
The owner undertakes not to circumvent the platform.
👉 Any attempt to:
- deal directly with a client brought in by Senegal Rent
- avoid payment of commissions
- divert bookings
may result in:
- immediate suspension of the account
- removal of listings
- billing of the commissions owed
10. Liability
Senegal Rent may not be held liable for:
- disputes between the owner and the client
- cancellations or incidents relating to the stay
- decisions made by partner platforms
11. Suspension / Termination
Senegal Rent reserves the right to suspend or terminate an account in the event of:
- non-compliance with these Terms
- non-payment
- insufficient quality of the accommodation
12. Data and access
The owner authorizes Senegal Rent to:
- create and manage listings on their behalf
- distribute the information on partner platforms
- optimize content and prices
12.1 Creation of the certified account
By accepting these Terms, the owner requests the opening of a certified account on Senegal Rent. This account is opened in the name of the person who manages the property on site — the owner themselves, or the manager they appoint — since it is that person who keeps the calendar and receives travellers.
This account gives access to the owner area, which allows photographs of the accommodation to be uploaded, bookings to be viewed, and the calendar link (iCal) to be retrieved so that those bookings can be carried over into the diary the manager already uses.
Identification. The account is identified by the manager’s WhatsApp telephone number, and sign-in is by a code sent to that number. An email address is not required: an owner or manager who does not have one accesses their area by that number alone. Any change of number must be notified to us, failing which access cannot be restored.
Data collected. To open this account and to draw up these Terms, Senegal Rent collects the manager’s surname and first name, their telephone number and, where applicable, their email address, company name, tax identification number (NINEA) and an identity document. This information is used to identify the partner, to draw up the contractual documents and for invoicing. It is shared within the Wepulse group — Wepulse Limited, a company incorporated under Irish law, registered with the Companies Registration Office of Ireland under number 812258 — which includes Senegal Rent, Que Faire Sénégal, TownPulse and Pulse Messaging, so that the partner does not have to provide the same documents more than once from one service to another. It is neither sold, nor rented, nor transferred to third parties outside the group.
Certified resident status. The account thus opened carries certified resident status, which gives entitlement to resident rates on bookings made by its holder in a personal capacity. This status attaches to the person, not to the accommodation, and may be withdrawn if the residence conditions are no longer met.
One account per person. Where the manager is already known to Senegal Rent, in whatever capacity, no second account is created: the existing account is completed. The same manager may administer several properties from a single account.
The owner may at any time request the closure of this account; such closure entails the loss of access to the area and to the calendar link, without affecting bookings already confirmed.
12.2 Communications from the group’s partners — optional
The partner may agree to receive, by email or by messaging, information and offers from the other services of the Wepulse group and from their partners, distributed by Pulse Messaging.
This consent is optional and separate from acceptance of these Terms. Refusing it has no effect on the listing of the accommodation, on rates, on access to the owner area, or on any right arising from these Terms. It is collected separately, by an explicit request to which the partner responds freely; it is never presumed, nor inferred from acceptance of these Terms, nor from silence.
The partner may withdraw it at any time, without giving reasons and without delay, using the unsubscribe link included in every message or on simple request to Senegal Rent. Withdrawal has no effect on the communications necessary for the performance of these Terms — bookings, invoicing, service information — which continue to be sent to the partner.
In the absence of consent, the partner’s contact details are used solely for the performance of these Terms and are not passed on to any commercial partner.
13. Amendment of the Terms
Senegal Rent reserves the right to amend these Terms at any time.
14. Applicable law
These Terms are governed by the law in force in Senegal.
Annex 1 — Optional paid offers
Scope of this annex. The offers described below are optional. This annex applies only to an owner who expressly subscribes to one of them; failing subscription, it is of no effect and the listing remains free of charge on the conditions set out in Article 3. Where there is a subscription, it governs the definition of the service, its content, its price and its duration, and prevails over any earlier or concurrent commercial presentation.
Amounts are expressed in CFA francs and are inclusive of all taxes: the owner pays the amount stated, with no supplement. Value added tax at the rate in force in Senegal, being 18% at the date of these Terms, is included in it; its amount is shown alongside each offer and appears on the invoice, so that an owner who is liable for VAT may reclaim it. An owner who is not liable does not recover it: it forms part of the price.
A.1 — Premium Pack
50,000 FCFA inclusive of all taxes, in a single payment — that is, 42,373 FCFA excluding tax and 7,627 FCFA of value added tax.
Purpose: to make the listing more attractive and more professional. The Premium Pack includes:
- a photo shoot by a photographer, with aerial shots where the property allows;
- optimized copywriting for the listing, designed to convince the traveller and to rank in search results;
- thirty days of featured placement on Senegal Rent, from publication of the listing;
- price optimization according to the market;
- award of the “Top property” badge, according to the overall quality of the property.
The “Top property” badge is a matter for Senegal Rent’s assessment of the overall quality of the property; it may be withdrawn if that quality is no longer observed.
Photographs taken in this context belong to the owner. The files are handed over to them and they may use them freely. The owner grants Senegal Rent the right to use them for the distribution of their listing, on the Platform and on partner channels, throughout the period of listing. When the listing ends, Senegal Rent ceases to use them and removes them from its media, subject to the time frames specific to third-party platforms.
A.2 — Visibility Pack
150,000 FCFA inclusive of all taxes in set-up fees — that is, 127,119 FCFA excluding tax and 22,881 FCFA of value added tax — then 50,000 FCFA inclusive of all taxes per month, that is, 42,373 FCFA excluding tax and 7,627 FCFA of value added tax.
Purpose: the distribution and management of listings beyond Senegal Rent. The Visibility Pack includes:
- the creation and full management of listings on several booking platforms, in particular Airbnb, Booking.com, Vrbo and Google, subject to their availability and their own admission conditions;
- real-time calendar synchronization, in order to avoid double bookings;
- ongoing price optimization according to the season, events and observed performance;
- priority featured placement, in particular in the “last minute” section;
- regular performance monitoring: occupancy rate, average revenue per night, seasonality.
The subscription is monthly and with no minimum term; it ends at the close of the current month on simple request by the owner, and the set-up fees remain due to Senegal Rent. Senegal Rent guarantees neither the admission of the accommodation by a third-party platform, nor a volume of bookings: its obligation relates to implementing and monitoring the distribution.
Subscribing to a paid offer has no effect on the remuneration described in Articles 5 and 5 bis: it changes neither the displayed price, nor the booking fee payable by the client.
