1. Purpose
These Terms of Use (the “Terms”) set out the terms and conditions for using the Senegal Rent platform, which connects users wishing to book accommodation with owners offering properties for rent in Senegal.
Senegal Rent acts exclusively as an intermediary and is not a party to the rental agreement entered into between the user and the owner.
2. Description of the service
The Senegal Rent platform allows users to:
- browse accommodation listings
- book accommodation for a given period
- pay the booking fee required to book accommodation
- get in touch with the owner
Payment of the balance of the stay is made directly to the owner on arrival or according to the terms agreed between the parties.
3. Booking and payment
To book accommodation, the user pays a booking fee equal to 20% of the rental price, i.e. about 19% of the displayed amount. Value added tax at the rate in force in Senegal is added to that fee. This fee compensates the Platform for its intermediary service and is owed to it on that basis. It constitutes neither an advance payment nor earnest money on the price of the stay. The total amount stated in the listing is not increased by it: the booking fee is a component of that amount, paid online at the time of booking, with the balance paid directly to the owner.
This fee covers:
- validation and blocking of the dates
- being put in contact with the owner
- processing of the booking
The remaining balance is to be paid directly to the owner.
For certain properties (in particular villas in high season or long stays), the owner may request an advance on the balance of the stay in order to guarantee the booking. This condition is indicated in the listing before booking.
This advance is paid directly to the owner, who collects it and is solely responsible for refunding it. It is deducted from the price of the stay and follows the same cancellation policy as the booking fee: refundable by the owner for as long as free cancellation remains open, and retained by the owner thereafter. It is distinct from the booking fee, which the Platform collects for its own service.
4. Cancellation policy
The user may cancel their booking under the following conditions. The applicable season is determined by the arrival date, not by the booking date.
- Low season (June 1 to October 31): free cancellation up to 7 days before the arrival date
- High season (November 1 to May 31): free cancellation up to 14 days before the arrival date
In the event of cancellation before this deadline, the booking fee is refunded in full. In addition, and independently of the timeframes set out above, a contractual right of cancellation, granted by Senegal Rent, applies. Any booking may be cancelled within the 24 hours following payment of the booking fee, with a full refund of that fee. The period runs from the date of payment. This right applies regardless of the season and regardless of the arrival date, including for a last-minute booking. It does not apply where the booking is made less than 48 hours before arrival: the owner then immediately begins preparing the accommodation. The refund is processed within 24 hours; if this deadline falls on a Saturday, Sunday or public holiday, it is processed on the next business day. The time it then takes for the funds to reappear in the user's account depends on their bank.
After this deadline, the booking is final: the booking fee is retained and is non-refundable. Half of this fee (50%) is paid to the owner as compensation for the dates that were blocked.
Last-minute bookings: any booking made less than 7 days (low season) or 14 days (high season) before the arrival date is final as soon as it is confirmed and the booking fee is non-refundable, subject to the 24-hour contractual right of cancellation set out above. The user may nevertheless request, no later than 48 hours before arrival, a postponement of their dates (once only, subject to availability of the accommodation).
5. Role of the platform
Senegal Rent acts solely as a technical intermediary putting parties in contact.
As such:
- the platform does not handle payments for the stay (other than the booking fee)
- the platform is not responsible for the performance of the stay
- the rental agreement is entered into directly between the user and the owner
6. Liability
Senegal Rent may not be held liable for:
- the quality, conformity or availability of the accommodation
- cancellations or changes made by the owner
- disputes between the user and the owner
- damage occurring during the stay
The user is invited to check the information provided in the listing before making any booking.
7. User's undertaking
The user undertakes to:
- provide accurate information when booking
- comply with the owner's conditions
- pay the balance on site
- behave respectfully during the stay
8. Modification or cancellation by the owner
In the event of an exceptional cancellation by the owner:
- the platform undertakes to offer an alternative solution if possible
- failing that, the booking fee is refunded to the user in full
9. Personal data
The personal data collected is used in connection with the management of bookings and the customer relationship.
It may be disclosed to the owner solely in connection with the booking.
10. Amendment of the Terms
Senegal Rent reserves the right to amend these Terms at any time.
The new terms apply to bookings made after they are published online.
11. Applicable law
These Terms are governed by the law applicable in Senegal.
In the event of a dispute, an amicable solution will be sought as a priority.
